10 years from the filing date and every 10 years thereafter. Please note that the current law, effective in Kenya since 22 August 2002, changed the initial term of a trademark registration and the renewal term to 10 years. The Register has interpreted this so that all the trade marks for which the Certificates of Registration issued after 22 August 2002 were valid for a 10 year term, irrespective of when the application was filed.
Use Provisions
A registration will be open to an action for cancellation if there is no bona fide use or legitimate excuse for non-use for a period of 5 years preceding such action.
