The Trade Marks Ordinance 1996 came into force in the Falkland Islands on 15 October 1996. The Ordinance repeals the previous law allowing for separate registration of U.K. registered marks.  Applications for registration or renewal in the Falkland Islands have not been possible since that date.

The new law provides that trade mark rights obtained in the U.K. automatically extend to the Falkland Islands.

Duration

A registration expires upon expiry of the base parent patent.

Renewal

Renewal fees are payable annually, on each anniversary of the filing date of the base parent patent, once the application has been filed in the Falkland Islands.
