Use Provisions
Non-use of a trade mark for a period of 3 years from register renders it vulnerable to an action for cancellation by third parties. The Law provides that a Declaration of Use must be submitted with a renewal application, stating that the mark has been used in the three years prior to the renewal date, or that there are legitimate reasons for non-use; however, this provision is not currently enforced.

NB: The United Republic of Tanzania includes mainland Tanganyika and the island of Zanzibar, but any such patent is enforceable in Tanganyika only. Please contact us for further information.
Types of Patent
Patents are granted for an initial term of 10 years from the effective filing date. They may be extended for two further periods of five years on the request of the owner of the patent, or of a licensee. For each further period, proof to the satisfaction of the Registrar of working, or legitimate reasons for non-working, must be furnished and a fee must be paid. Each application for extension must be made not more than twelve months and not less than one month before expiration of the previous term of the patent.

There is no provision for independent design protection in Tanganyika. A design registered in the United Kingdom is (subject to the laws of Tanzania) automatically protected in Tanganyika.
