Use Provisions
An application for renewal must be supported by a declaration of use within 5 years preceding the renewal date in relation to at least some of the goods for which the mark is registered, or its use as a trade name. Non-use of a mark for a period of 5 years from registration renders it open to an action for cancellation by third parties.

Renewal
According to a resolution which came into force on 12 April 2004 and which supersedes all previous annuity payment regimes, annuities are now payable on each anniversary of the filing date of a patent application, beginning on the first anniversary that falls after the issuance of the notification of grant of the patent. Annuities may be paid late, within a 6 month grace period, but a surcharge will then also become due.
