International Arrangements

Although Angola acceded to the Paris Convention in 2007, no express provision has yet been made in Angolan law to implement Convention priority.  Nevertheless, it is advised to claim priority as the Angolan Registry appears to accept priority claims.

Renewal

10 years from the application date, and every 10 years thereafter.
There is a 12 month grace period available upon payment of a late fine, the cost of which increases after the first 4 months of the grace period.

Use Provisions

Non-use of a trade mark for a period of “years” from registration renders it open to an action for cancellation by third parties.  The number of years is not mentioned in the law, evidently due to a printing error, and it remains to be seen how the authorities will interpret the law in this regard.

Designs are registered for an initial term of 5 years from the filing date, which term is extensible for two further periods of 5 years each.

Renewal

Both annual fees and quinquennial renewal fees are payable during the lifetime of a registered design. Due dates are calculated from the local filing date.
