A draft withdrawal agreement between the UK Government and the European Union published on 19 March 2018 has indicated that owners of EU trade marks and Community designs will be granted an equivalent UK right following Brexit.

The IP right must have been registered before the end of the transition period, which runs from 29 March 2019 (Brexit date) until 31 December 2020. The surviving UK right will not require re-examination and will retain the same filing and priority dates. However, there is no mention of whether fees will be incurred for this process.
