The anticipated opening of the Myanmar Intellectual Property Office, expected to take place in January 2020, has been delayed. Whilst there are rumours that the Office may open in April 2020, no firm date has been set by the Myanmar authorities.
 
As previously advised, there is expected to be a “soft opening” of the Intellectual Property Office 6 months before the new law enters into force. During this transitional period, the IPO will accept applications for trade marks which have been recorded at the Registry of Deeds under the current system of trade mark protection in Myanmar. All applications filed in the transitional period will receive a filing date of the date the new law comes into force.
 
The Regulations, including the official fees, have yet to be published, and neither has the application form required for filing during the “soft opening” period. We have been advised that the fees and documents will only be released to the public after the commencement of the “soft opening” period, but as with the commencement date, we are unable to be certain about any information currently received from Myanmar.
