We have recently been advised that a modification to the Administrative Rule for the Patent Law (Executive Order No. 38308-JP) has been issued by the Costa Rican Patent Office, which states that annual fees in Costa Rica must be paid only with regard to patent applications filed on or after 25 April 2008 and only once the patent has been granted by the Patent Office. The first annuity is payable along with the fee for issuance of the grant certificate. The second annuity and any annuities which are pending at the date of grant must be paid within the two months following the date of grant. Annuities are payable before the last day of the month containing the anniversary of the local filing date. They can be paid in advance for two or more periods and as long as the patent is in full force. 

A six month grace period is available for paying an annuity, although a penalty of 30% of the annual fee is then payable.
